Cook's illicit activities were discovered by a private investigator hired by Rolex in late-2012. He was apprehended by Texas authorities and faced Dallas County Court in February.

Hoping to make amends for his wrongdoings, Cook posted an apologetic statement to his fans in April, stating he was not aware of the seriousness of his crimes. Rolex responded by using the statement as evidence of his guilt in the suit filed against him.
