US heavy metal act Five Finger Death Punch are reportedly being sued by their label, Prospect Park, amid allegations they have breached their contract in an effort to capitalise monetarily at the expense of frontman Ivan Moody’s health and welfare.

As Blabbermouth reports, Prospect Park filed a suit against the band after they refused to comply with a request for two new masters for a greatest hits record, with Five Finger Death Punch insisting on recording new material outside their contract, citing the health issues of Moody.

Moody is said to be in an in-patient rehabilitation facility, which follows on from the band’s sudden withdrawal from the Black Sabbath Australian tour this month with Moody hospitalised.

In the lawsuit that was filed on April 21, Prospect Park claim that Five Finger Death Punch are “shamelessly attempting to cash in before the anticipated downfall of their addicted bandmate.”

The band signed a four-album contract in December 2012, and September of last year saw them release their third album, Got Your Six.

Prospect Park says the band told them they would be using a producer of their own choice for their next release without input from the label and would not be complying with the contract timeline, which states they are not permitted to begin recording their fourth album before June 4 of this year.

"In rushing to record a new Fourth Album, FFDP is damaging itself and Prospect Park by cutting off the marketing and promotion and success of the Third Album, which is currently in its album cycle,” the lawsuit reads.

Prospect Park also allege the band are using their own assessment of Moody’s health to justify the shift in recording timeline and producer.

"In recent months, members of FFDP and their representatives have repeatedly told Prospect Park of their extreme concern for the health and well-being of Moody, whose escalating substance abuse is placing both the future of FFDP, and indeed his life, at risk. 

"On information and belief, Prospect Park alleges that the other members of FFDP seek to capitalize monetarily as soon as possible, at the expense of Moody's health and welfare, and the clear mandates contained in the Recording Agreement.”

Prospect Park is seeking a judgement that rules Fiver Finger Death Punch breached their contact, an injunction and are looking any compensatory damages.
