According to Mike Gunzelman, host of alternative online radio station program The Gunz Show, A Day To Remember are suing their label Victory Records for breach of contract. Gunzelman has said the following:

Legal action was reportedly initiated on May 31 this year, in which the band claims that Victory owes them over $75,000 in royalties.
