Kanye West’s lawsuit against a Melbourne burger shop has been thrown out of court.

Last year, it was revealed that Ye sent College Dropout Burgers a cease-and-desist notice, demanding that owner Mark Elkhouri paint over a mural of the US rapper, erase the logo of his restaurant that was inspired by the College Dropout album cover, as well as abandoning menu items that play on West's song titles.

Ye claimed that the shop had engaged in “misleading and deceptive conduct” by inferring that it had his sponsorship or approval.

As ABC reports, the case was dismissed by Justice Shaun McElwaine due to the fact that West had taken "no steps whatsoever” to progress the litigation in recent weeks.

Elkhouri’s legal team said it was clear that Ye was no longer interested in the matter, given his silence since “proceedings with all guns blazing” last year.

Outside of court, Elkhouri told reporters he was “very relieved” by the outcome AND that he would be giving away free cheeseburgers at his Ivanhoe store from 2-3pm tomorrow, Saturday, March 4.

Back in July, Elkhouri said he was initially excited when he saw that West had been viewing his burger store’s Instagram stories.

The shop’s old menu had a fried chicken burger called Golddigger, a breakfast burger named Good Morning and a Cheezus burger named after his album Yeezus.

“It’s pretty hard being a Kanye West fan with this situation, we have to respect his wishes and move forward,” Elkhouri told The Age at the time. 

“The fact he was viewing our [Instagram] stories and was there had me believe he was a fan of us.”
