US Duo & French Airline Sued For Allegedly Ripping Off 'Love Is In The Air'

A US electro-pop duo and France's national airline have been sued for allegedly ripping off John Paul Young's classic song, Love Is In The Air.

According to Fairfax, music legends, Harry Vanda and the late George Young, filed the lawsuit in Federal Court just days before Young passed away in late October

It is alleged Oregon act Glass Candy's track, Warm In The Winter, contains similarities to Vanda and Young's 1977-released tune, while Societe Air France has also been named as a defendant for using Love Is In The Air in a 2015 advertising campaign, 'France Is In The Air'.

While Glass Candy's song was originally released in 2011, it received international attention when it was used in the French airline ad.

Vanda & Young were given permission to push forward with the lawsuit on Friday.

"The applicants say that Warm in the Winter contains the same line Love is in the Air as the applicants' song and that, in effect, the melody for that line is also the same," Justice Nye Perram said.

"There is also some evidence that the subsequent chordal structure of both songs is the same.

"I have listened to both songs and doing so arguably supports that view. I am satisfied, therefore, that there is a prima facie case."

The news comes just days after it was revealed Australian songwriters, former Thirsty Merc member Sean Carey and Beau Golden, have filed a lawsuit against Ed Sheeran, Tim McGraw and Faith Hill for allegedly ripping off a 2014 song they wrote together.
